Excerpt from a template mandate agreement for the technical safety service

The tasks of the technical safety service are:

  1. To complete and update OHS documentation, which for the purposes of the agreement is defined as:
    1. the drafting of an OHS policy if the obligation to complete an OHS policy in writing exists for the principal under specific legislation (specifically § 6 (1)(k) of Act No. 124/2006 Coll.);
    2. a list of work and workplaces
      - prohibited for pregnant women, other women until the end of the ninth month after childbirth and nursing mothers
      - associated with specific risks for pregnant women, other women until the end of the ninth month after childbirth and nursing mothers,
      - prohibited for youth employees;
    3. a list of provided personal protective equipment;
    4. the principal’s internal regulation specifying how hydration supplies are provided to its employees;
  2. Completes:
    1. analysis to determine the cause and investigates accidents at work, other injuries and near misses.
    2. notification of the principal’s employees and testing of their knowledge concerning OHS requirements (§ 7 of Act No. 124/2006 Coll.) upon their hiring (“new-hire employees”) in the periods specified in Subsection 2 of Annex 2 hereto,
    3. repeated notification of the principal’s employees and testing of their knowledge concerning OHS requirements (§ 7 of Act No. 124/2006 Coll.) in the periods specified in Subsection 6 of Annex 2 hereto.
    4. methodology-based guidance for the principal’s employees,
    5. breath tests to determine the use of alcoholic beverages at the principal’s workplaces during business hours (from Monday to Friday from 7:00 am to 4:00 pm) in the periods specified in Subsection 7 of Annex 2 hereto. Every additional breath test (outside of the principal’s business hours or outside the scope specified in Subsection 7 of Annex 2 hereto) shall be conducted by the agent exclusively based on a written order from the principal and in the scope and under the conditions specifically agreed upon by the parties, whereby compensation for such test shall be billed to the principal outside the framework of the lump sum compensation agreed in Article IV herein.
  3. Checking the status and level of management and care for OHS, the condition of workplaces, compliance with safety requirements, prohibitions on work for women and youth, compliance with conditions requiring professional competency, the assignment and use of personal protective equipment in the periods specified in Subsection 8 of Annex 2 hereto.
  4. Ordering the principal’s component manager to take the necessary OHS-related precautions if there is an immediate threat to the health and safety of employees.
  5.  Providing the following to the principal (after completing the checks pursuant to Subsection 3.3 herein):
    1. information on the status and development of OHS at the workplace, and
    2. proposals to resolve OHS conditions and proposals to remedy deficiencies (modification of the workplace, activities, equipment and the like).
  6. Collaboration:
    1. with the principal’s management (when completing documents, proposing solutions, during checks, etc.)
    2. with the OHS committee, employee representatives for OHS and the occupational health service.
    3. with the executive body of the Labour Inspectorate for OHS matters
    4. with the principal’s management in identifying hazards, threats and assessing risks involved in all activities performed by the principal’s employees
